Health and safety is top of mind for nearly every Ontarian these days, as the pandemic continues to fundamentally affect our work and home lives. But how do you, as a legal professional, address not only the COVID-related aspects for your legal services practice, but all of the “normal” H&S matters as well? Our presenters are leading Ministry of Labour prosecutors, corporate defence counsel, and adjudicators who explore the latest developments in OHSA investigations and criminal prosecutions for workplace accidents. They discuss how they navigate new workplace risks and additional hurdles in the judicial system relating to court closures and delays, as well as:

  • How has the pandemic’s impact on the justice system affected the determination of unreasonable delay under s.11(b) of the Charter in OHSA prosecutions?
  • Has “creative sentencing” in OHSA cases arrived in Ontario?
